1. Eligibility
There are two types of family-based immigrant visas:Immediate Relative Visas: These are available to close family members of U.S. citizens, such as a spouse, child, or parent. There is no annual limit on the number of immigrants in this category.
Family Preference Visas: These are for more distant family relationships with U.S. citizens or certain relationships with Lawful Permanent Residents (LPRs). The number of immigrants in these categories is limited each fiscal year.
Keep in mind that U.S. citizens can file an immigrant visa petition for their:
- Spouse
- Son or daughter
- Parent
- Brother or sister
U.S. Lawful Permanent Residents can only file an immigrant visa petition for their:
- Spouse
- Unmarried son or daughter
2. Process
The process involves two steps:- The U.S. citizen or green card holder files a family visa petition, Form I-130 with USCIS. A separate Form I-130 is required for each person being sponsored.
- The foreign national relative applies to become a permanent resident.
